Maybe the software didn't set up the partitions correctly because the new drive is somewhat larger than the original, though that seems a pretty common thing for a hard drive replacement.

The build has been running for about a week with no issues, the drive is working well and the computer is faster on boot up and working than with the old SATA III

so I couldn't bring myself to just discard it and opted for replacing the hard drive with this Solid State Drive

During synthetic testing, the drive slows down somewhat when the 8GB cache fills up.

Just remember to go to the Partition Hard drive utility to format the drive

When it failed, the drive is unreadable and you cannot access any of the data (glad I had daily backups)
